You can obtain verbal consent to send text messages to customers, but be sure you're including specific details in your TCR registration
When you submit your business registration to The Campaign Registry (TCR), your registration is reviewed to verify the identity of your organization and to ensure you are obtaining and recording proper consent from your customers or patients to receive text messages.
If you are obtaining opt-in to receive text messages verbally, there are a number of practices you'll want to follow to make sure your campaign is approved by The Campaign Registry (TCR). Failure to follow these practices could result in your registration application being rejected.
Information You Are Required to Submit If You're Obtaining Opt-In Verbally
If you are creating a new account with Swell and indicate you are collecting opt-in VERBALLY, you will be asked to provide the following information:

Recommended Practices
Once TCR receives your registration application, they will review your application and ensure that you are collecting opt-in in an ethical way. To avoid having your application rejected, follow these best practices:
- Utilize a script (and include the script in your application). The easiest way to ensure that you're following best practices when obtaining verbal opt-in is to utilize a repeatable script. If you utilize a script, be sure to include it in your description of your workflow.
- Inform your customer of what kind of messages you'll send, and how often. For example, "We would like to send you messages about upcoming appointments and also reach out for feedback on the service we've provided. You shouldn't receive more than a few of messages every few months."
- Let them know they can opt out at any time. For example, "If you decide you don't want any more messages from us, you can opt out at any time.
